1. GENERAL PROVISIONS
1.1 Fundacja Przekrój with its registered office in Warsaw, Aleja Róż 10/12, 00-556 Warszawa, entered in the Commercial Register of the Polish Court Register under KRS number: 0000750752, NIP: 7010868991, REGON: 381419318 is the publisher of the website Przekrój.pl.
1.2 Przekrój is highly committed to the protection of privacy of Przekrój website users and the security of their personal data processing.
2.1 Cookies – files recorded on the Customer's equipment which store settings and other information used on websites visited by the Customer.
2.2 Customer – (1) a natural person with full legal capacity and, in cases provided for in generally applicable regulations, also a natural person with limited legal capacity, who has entered into or intends to enter into a Sale Agreement with Przekrój, a natural person entering into a transaction with a business undertaking not directly related to his/her business or professional activity; (2) a legal person; or (3) an unincorporated organizational unit, which has statutory legal capacity and which has entered into or intends to use services provided electronically made available by Przekrój, and to enter into a Sale Agreement with the Seller.
2.3 Przekrój – the seller at the Online Store and owner of the Internet domain www.przekrój.pl, i.e. Fundacja Przekrój with its registered office in Warsaw, Aleja Róż 10/12, 00-556 Warszawa, entered in the Commercial Register of the Polish Court Register under KRS number: 0000750752, NIP: 7010868991, REGON: 381419318.
2.5 GDRP – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDRP);
2.6 Online Store – a platform for the sale of Goods by Przekrój via the Website.
2.7 Przekrój Website – Przekrój website at https://przekroj.pl/, through which the Online Store may be accessed.
2.8 Goods – a movable item available at the Online Store which is the subject of the Sale Agreement between the Customer and Przekrój.
2.9 Sale Agreement - a sale agreement within the meaning of the Civil Code concluded with the use of means of remote communication between the Customer and the Przekrój.
2.10 Electronic Service – service provided electronically by Przekrój within the meaning of the Act of 18 July 2002 on provision of electronic services (consolidated text in Dz.U.2019.123).
3. PERSONAL DATA PROTECTION
3.1 Personal data processing
Personal data is processed in accordance with the Act of 10 May 2018 on personal data protection (Dz.U.2018.1000), and GDRP – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L 119, p. 1), as well as other legal acts supplementing or replacing the above mentioned regulations.
3.2 Personal data controller
Fundacja Przekrój with its registered office in Warsaw, Aleja Róż 10/12, 00-556 Warszawa is the personal data controller.
3.3 Purpose of personal data processing
The data will be processed for the purpose of performing the for the Electronic Services contract and sending the newsletter, as well as for the direct marketing of the Controller's and third party products and services (in the latter case, provided that consent has been given for the processing of personal data for the purpose of third party marketing).
3.4 Basis for personal data processing
Each time the purpose and scope of data processed by the Controller depend on your activities on the Website and are based on the provisions of law.
A legal basis for personal data processing is:
(a) the Customer's consent - Article 6(1)(a) of GDRP (the use of the Przekrój Website’s full functionality requires full legal capacity);
(b) the purpose of concluding and performing the contract of sale and the contract for the provision of electronic services (registration and maintenance of an account at the online store - Article 6(1)(b) of the GDRP;
(c) having to comply with Przekrój’s legal obligations - Article 6(1)(c) of the GDRP;
(d) processing necessary for purposes resulting from Przekrój’s legitimate interests (ensuring security, development and optimal operation of the Przekrój Website and the Online Store, improvement of the quality of services, protection of rights and enforcement of claims) - Article 6(1)(f) of the GDRP;
(e) for purposes arising out of the legitimate interests pursued by the Controller’s group entities (business development, improvement of service quality, market monitoring);
(f) for direct marketing of own services and services of the Controller’s group entities if the User agrees to it;
(g) for purposes arising out of the legitimate interests pursued by Przekrój’s group entities (business development, improvement of service quality, market monitoring).
3.5 Type of data collection and its processing
In connection with providing the Electronic Service, the following Customer data is processed:
(a) first and last name;
(b) mailing address;
(c) e-mail address to which Messages will be sent;
(d) contact number (if any);
(e) Internet behavior data - time spent on the Controller’s websites visits to particular websites.
The Controller receives personal data directly from the User, and data referred to in letter (e) above through Cookies.
3.6 Transfer of data outside the European Union
Personal data will not be transferred to third countries.
3.7 Use of data for automatic decision making or profiling
Data will not be subject to automatic decision making or profiling.
3.8 Data storage period
Data will be stored as long as the Electronic Service is provided and thereafter for another year from the last event that may give rise to possible claims. For some claims, this period may be extended if a longer prescription period is provided for by law. The storage period for data processed for accounting purposes and for tax reasons will be in accordance with the applicable laws. After such periods the data will be erased or anonymized.
3.9 Requirement to provide data
Providing personal data is voluntary, but necessary for rendering the Electronic Service and to receive a newsletter. Data indicated as provided with the User’s consent is given voluntarily, however, if it is not provided, Przekrój will not be able to render its services and the Customer will not be able to receive the newsletter. If consent to the processing of personal data for the Controller’s direct marketing purposes is withdrawn, it will not be possible to perform the Electronic Service and newsletter service.
3.10 Customer’s rights
The personal data Controller will ensure:
(a) the right to withdraw consent at any time without affecting the lawfulness of processing carried out on the basis of consent prior to its withdrawal (Article 13(2)(c) of GDRP);
(b) the right of access to data (Article 15 of the GDRP);
(c) the right to request a rectification of data (Article 16 of the GDRP);
(d) the right to request deletion of data (Article 17 of the GDRP);
(e) the right to demand restriction of processing (Article 18 of the GDRP);
(f) the right to data transfer (Article 20 of the GDRP);
(g) the right to object to data processing (Article 21 and Article 6(1)(f) of the GDRP);
(h) the right to transfer data, i.e. to receive data which has been transferred to the controller in a structured, commonly used and machine-readable format, as well as the right to transfer such personal data to another controller.
The above rights can be exercised by sending an e-mail to the following e-mail address firstname.lastname@example.org.
We also inform you of your right to lodge a complaint with the data protection supervisory authority.
4.3 Cookies are small text files that are automatically saved on the Customer's terminal equipment when they are browsing Przekrój Website or Online Store. Cookies usually contain the domain name of the website from which they originate, the time they are stored on the terminal equipment and a unique number.
4.4 Service cookies
(a) user input cookies;
(b) authentication cookies;
(c) user centric security cookies;
(d) multimedia player session cookies;
(e) user interface customization cookies,
(f) cookies used to monitor traffic on the Przekrój website, i.e. for data analytics, including cookies:
(i) used by entity contracted by the Controller to process personal data – for Przekrój Website audience measurement, including the Online Store, and for analyzing the way in which Przekrój Website and Online Store are used by Customers, including the creation of statistics and reports on the Przekrój Website and Online Store operations;
(ii) Google Analytics files, i.e. files used by Google contracted by Przekrój as the personal data controller to process it in order to analyze the way in which Przekrój Website and Online Store are used by the Customer, including the creation of statistics and reports on the Przekrój Website operations;
4.5 Two basic types of cookies are used on the Website: session cookies and persistent cookies. Session cookies are temporary files that are stored in the Customer's terminal equipment until the Customer logs out, leaves Przekrój Website or the software (web browser) is turned off. Persistent cookies are stored in the Customer's terminal equipment for the time specified in the parameters of cookies or until deleted by the Customer.
4.6 Przekrój Website uses the following types of cookies:
(a) “strictly necessary” cookies enabling the use of services available on the Przekrój Website, e.g. authentication cookie used for services requiring authentication on the Przekrój Website;
(b) “performance” cookies that collect information on how visitors use Przekrój Website;
(c) functional cookies allow “remembering” the Client’s customization and Customer’s interface personalization.
4.7 Time of storing cookies is specified in the browser’s cookie settings. You can configure your browser to accept cookies without having to decide whether or not to accept them each time you use the Przekrój Website.

5. FINAL PROVISIONS
5.2 Przekrój applies technical and organizational measures ensuring the protection of the processed personal data adequate to the risks and categories of protected data, and in particular protects data against disclosure to unauthorized persons, collection of data by an unauthorized person, processing in violation of applicable regulations, as well as change, loss, damage or destruction.
